Luvaas Cobb is a leader in this area of practice, regularly representing 13 school districts in the Willamette Valley alone. Joe Richards, the firm’s managing partner for this area, has represented school districts for 27 years, regularly providing advice in the following areas:
School District Liability Claims: Cases for which we’ve obtained successful outcomes include premises liability, failure to provide adequate supervision or instruction, student bullying and harassment, unconstitutional searches, and the defense of claims brought under Title IX, 42 USC Section 1983, and the Individuals with Disabilities Education Act.
Civil Rights: We provide counsel on the broad range of civil rights issues that confront schools including free speech, student searches, gender identification, and religious garb and practices. We advise schools on the development and application of policies in these areas to ensure compliance with constitutional and statutory protections of students and teachers.
Employment/Labor Relations: We regularly represent districts on claims brought by employees alleging wrongful discharge, denial of due process, sexual harassment, and employment discrimination. We provide advice on union contract negotiations, unfair labor practice complaints and the arbitration of grievances under collective bargaining agreements.
Public Contracting: We assist with transactions involving real estate, goods and services, and construction contracts.
